What's New?

Our legal system has evolved over hundreds of years, and is rooted in British Common Law. The doctrine of stare decisis governs the evolution of our laws, and as a result, the law is ever-changing in response to the needs of our society.

At Bisno, Samberg & Mulvaney we strive to stay current as the law changes and evolves. In fact our attorneys are frequently called upon to speak at seminars where other lawyers come to learn about changes in the law, and to obtain continuing legal education credits.

Here are a few topics of current interest.

Changes in the Uniform Commercial Code. Transactions secured by interests in personal property are governed by Article 9 of the Uniform Commercial Code (the 9000 series of the California Commercial Code). After dozens years basically unchanged, Article 9 was recently revised to be more "creditor friendly". As a result, how security interests are taken and perfected has changed dramatically.

Changes in the Bankruptcy Code. The protection available to debtors by the Federal bankruptcy laws is changing dramatically. It is anticipated that by early 2002 the laws will have been rewritten so as to substantively effect the rights of creditors and debtors alike.

If you or your business are involved in secured transactions, or have a case involving bankruptcy issues, it is imperative that you have up to date information. Please feel free to contact Bisno, Samberg & Mulvaney by telephone (818) 657-0300, or e-mail us with your questions.

Who's who in the news. Dennette Mulvaney and John Samberg recently presented a full day seminar for Lorman Education Services on the subject of real property foreclosure law in California. Lorman has asked Mr. Samberg to prepare, present and moderate two additional seminars in early 2002 on the subjects of litigation management and purchasing law in California.

Peter Bisno and John Samberg were recently referred a products liability defense case from Arizona involving a wholesome food supplement that purportedly injured a consumer. Mr. Samberg has been specially admitted to the Arizona Bar for this matter (pro hac vice), and Mr. Bisno's special application is pending.

In addition to her thriving bankruptcy practice, Dennette Mulvaney recently became a licensed real estate broker. She is also writing a cook book, which is scheduled to be published in 2002.
