Medical Malpractice

Medical malpractice occurs when a doctor, hospital, nurse, or HMO (health maintenance organization) acts negligently and incompetently, causing serious injury or death to the patient.

All too frequently, a doctor will fail to diagnose a serious ailment, or negligently treat a patient, with disastrous and catastrophic results. The patient can either "look the other way" and do nothing, or sue the negligent doctor. Historically, patients have been hesitant to sue doctors for a variety of reasons, and when most doctors are sued, they vigorously defend their wrongful conduct and try to portray the patient, the real victim, as having done something wrong.

It is very difficult for malpractice victims to obtain compensation. In California, the state legislature has passed laws that limit the general damages (pain and suffering) in malpractice cases to $250,000.00, and have imposed other limitations stacking the deck against the victim. When cases are tried to their conclusion, the "out of pocket" costs incurred by the victim's attorney (expert fees, jury fees, court reporter fees, etc.) can easily exceed $30,000.00.

  • HMO failed to diagnose a rare form of cancer. HMO refused to pay any money in settlement. The victims received $1.5 million after a successful binding arbitration.
  • Failure to diagnose lung cancer.
  • Failure to diagnose breast cancer.
  • Kidney dialysis machine failure. The victim's family received well over $100,000.00.
  • Brain tumor undiagnosed by HMO. The victim's family received a structured settlement, whose pay out exceeded $1 million.
  • Botched episiotomy repair. HMO was forced to pay $50,000.00.
  • Botched delivery of child with shoulder dystocia and brachial plexis injury. The victim who now has Erb's palsy was given a substantial settlement and lifetime medical care.
  • Botched delivery of twins.
  • Botched kidney biopsy.
