John M. Samberg

John M. Samberg is a veteran trial attorney with over 25 years experience in the litigation arena, first as a private detective, and then as an attorney. Mr. Samberg received his undergraduate degree from UCLA, and spent over 10 years working as a private investigator specializing in whereabouts, financial and background investigations. He then attended Southwestern University School of Law, graduating in 1984 ranked 4th in his class - Magna Cum Laude.

As a trial attorney, Mr. Samberg has distinguished himself with his peers and the bench. He has obtained multi-million dollar awards in trial and arbitration proceedings, and has litigated several multi-week jury trials. Mr. Samberg has litigated business cases, as well as major injury and wrongful death cases, in State, Federal and Bankruptcy Court, and in multiple jurisdictions, including California, Arizona, Nevada, Utah, Illinois and Maine. His experience encompasses jury and bench trials, arbitration and mediation.

Based upon a survey of attorneys and judges familiar with Mr. Samberg, Martindale-Hubbell has given him its highest "AV" rating for competence and ethics - www.martindale.com. A few examples of Mr. Samberg's broad and successful litigation practice follow:

State Court Jury Trial. Six week jury trial in San Bernardino County involving a train vs. auto accident resulting in death and serious injury. Mr. Samberg represented the Plaintiff and obtained a jury verdict of nearly $1.4 million (reduced by 50% for Plaintiff's comparative fault).
Federal Court Trial. Bankruptcy Court adversary proceeding in Los Angeles involving valuation of a commercial recording studio; at issue, over $1 million. Mr. Samberg represented the Plaintiff (a bank) and prevailed on every issue of valuation, resulting in a complete victory for the bank.
Mediation. Complex multi-party truck accident case involving the mysterious collision of two big rigs in the middle of the night in the Utah desert, killing both drivers. Mr. Samberg was specially admitted to the Utah Bar (pro hac vice) in order to handle this case on behalf of the widow and two small children of one of the deceased drivers. Although the police report listed no witnesses, as a veteran private detective Mr. Samberg was able to locate two eye witnesses who provided critical information that led an accident reconstruction that proved that the clients' husband/father was not a fault. Mr. Samberg won settlements for the clients of $1,500,000.00 cash, and with his assistance, the clients were also able to obtain a structured settlement of part of the proceeds with lifetime benefits well in excess of $2,000,000.00.
State Court Trial. One week jury trial in Tuscon, Arizona. Mr. Samberg prosecuted an action on behalf of a Southern California bank against personal guarantors of a loan to a bankrupt Arizona limited liability partnership. Mr. Samberg was specially admitted to the Arizona Bar (pro hac vice) and obtained a judgment against the defendants of over $2,000,000.00.
State Court Trial. Two week bench trial in Los Angeles County involving a failed restaurant. Mr. Samberg represented the Defendants and defeated the Plaintiffs' claims of fraud and mismanagement.
State Court Trial. One week bench trial in Los Angeles County involving failure of a construction developer to pay a general contractor for work performed. Mr. Samberg was able to obtain a judgment for the general contractor against not only the corporate defendant, but was also able to pierce the corporate veil and obtain a judgment personally against the individual owner of the development company.
Mediation. Complex multi-party construction defect case involving the roof of a shopping center. Mr. Samberg represented one of the principal Defendants and after the case was successfully resolved with a minimum contribution by our client, its insurance company wrote a lengthy unsolicited letter praising attorney Mr. Samberg's superb work on the case. Mr. Samberg saved hundreds of thousands of dollars for the insurance company as a result of his thorough preparation, and impressive presentation.
While attending law school, Mr. Samberg earned numerous academic awards, including a remarkable seven American Jurisprudence Awards (highest grade of all class members in core subjects), and two national Moot Court best oralist championships (national oral advocacy competitions among dozens of law schools top students). Upon graduation, based on his academic excellence and national advocacy honors, Mr. Samberg was chosen by the Dean of Southwestern University as the sole recipient from his graduating class to receive the prestigious American Board of Trial Advocates (ABOTA - www.abota.org) Award for Excellence in Preparation for Trial Practice of Law.

In addition to his busy law practice, Mr. Samberg is also a member of the Los Angeles County Superior Court Arbitrator and Mediator panels, and an Los Angeles Municipal Court Judge Pro Tem. He is a frequent guest speaker at Credit Managers Association of California and the National Association of Credit Manager's meetings. He has served on the faculty of UCLA Extension, and teaches business law in the Credit Managers Association of California credit professional certification program. Mr. Samberg is also a Lorman Education Services CLE speaker, and presents seminars to other attorneys and business and credit industry professionals.

Mr. Samberg was born in New York City in 1955, is happily married and has two children. Mr. Samberg has traveled extensively in Western Europe, and enjoys outdoor sports activities, including scuba diving (NAUI divemaster - www.naui.org) and motorcycling - www.ama-cycle.org.
