Major injury and wrongful death cases receive particularly special attention due to the severe and permanent manner in which these cases effect peoples lives. One of our partners, John Samberg, was nearly killed in a traffic accident several years ago (head-on motorcycle accident), so we know first-hand how these tragic cases dramatically effect the lives of both the victim, and the family of the victim.

Our attorneys bring the highest level of training, skill and commitment to these cases. We have handled cases from coast-to-coast, and Bisno, Samberg & Mulvaney has attorneys licensed in California, Nevada, New York and Arizona. We handle cases in other states by special case admission known as pro hac vice. We work with attorneys in other states as well, and we handle all cases in the Mountain States and in the Western United States.

At Bisno, Samberg & Mulvaney we are proud that many of our cases are referred to us by former clients and by attorneys who represented past opponents of ours. Also, our work does not stop when the trial or settlement is won. We routinely help our clients by negotiating downwards various medical and other liens, and in appropriate cases, by assisting clients in working with structured settlement professionals. We provide this service at no charge to our clients.

Bisno, Samberg & Mulvaney is not afraid to take on the "big guns". We regularly litigate cases against insurance companies and major corporations. We represent policyholders whose own insurance companies refuse to pay.

Our personal injury department handles cases on a "contingency fee" basis. We are paid a percentage of monies recovered by the client.

Major injury and wrongful death cases arise all sorts of circumstances. Whether you are at home, at work, on the road, or even in the air, tragedy can strike. Even if you are the victim of a violent crime, or a traffic accident that involves just one vehicle, there may still be a meritorious case to pursue.

We have had the privilege of assisting victims and their families in cases arising from not only conventional traffic accidents, but also from very unusual events. Here are just a few examples of the challenging cases we have handled:

  • Train accident: train vs. car at crossing at grade (California desert). Wrongful death (wife) and major injury (husband). Bisno, Samberg & Mulvaney represented the victim whose car was hit by a train, rendering him partially paralyzed, and killing his wife. We sued Santa Fe Railroad and Union Pacific Railroad and won. The jury trial in 1997 lasted over six (6) weeks, and the jury returned a gross verdict in excess of $1 million. The lead trial attorney, John Samberg, is also a private investigator, and he personally conducted the field investigations. He located a key witness, whose name did not even appear on the police report, who provided dramatic and critical testimony at trial. This case was referred to Bisno, Samberg & Mulvaney by another law firm based on our excellent reputation and history of winning performance.
  • Motorcycle accident: cement truck vs. motorcycle at intersection (metropolitan Los Angeles). Wrongful death (adult son). Bisno, Samberg & Mulvaney represented the family of a victim whose motorcycle was hit by a cement truck at an intersection only a few blocks from home. Our vigorous work commenced just a few days after the accident. Based on a strong work-up and investigation, the case settled in the six-figures a few weeks later, without a law suit having to be filed.
  • Single vehicle roll-over car accident: passenger in car partially paralyzed when driver fall asleep at the wheel and rolled the car in the desert near the Nevada and California border. Bisno, Samberg & Mulvaney represented the victim against the car rental company that denied insurance coverage, and asserted comparative fault against our client for failure to wear a seatbelt. The defendants claimed that the maximum coverage was $15,000.00 and refused to pay a penny more. After many years of hard fought and extremely difficult litigation against three (3) separate law firms (all paid by an insurance company and a major car rental company), the case settled for cash payouts of approximately $1,500,000.00. Lead counsel John Samberg personally conducted the field investigations in this highly challenging and complex case. This case was a lawyer referral to Bisno, Samberg & Mulvaney by another law firm based on our excellent reputation and history of winning performance.
  • Stabbing incident: man stabbed while sitting on his front porch suffering severe and permanent injuries (metropolitan Los Angeles). Bisno, Samberg & Mulvaney represented the victim who was stabbed by criminals while sitting on his porch. We sued his landlord for not providing adequate security. The insurance company was confident that it would obtain a court ordered dismissal and asked the court to grant a summary judgment against the victim. Lead attorney Peter Bisno located a witness whose name was mentioned in a police report, but everyone else had overlooked. By obtaining that witness' statement, the case eventually settled for approximately $500,000.00. Lead attorney Peter Bisno tenaciously fought this difficult case for years and won. Many others would not have even thought there was a case to pursue. This case was a lawyer referral to Bisno, Samberg & Mulvaney by another law firm based on our excellent reputation and history of winning performance.
  • Pedestrians killed and injured: truck vs. utility pole, pedestrians injured and killed. Bisno, Samberg & Mulvaney represented the severely injured victim in a very unusual case involving a drilling rig truck hitting, and knocking over a utility pole (metropolitan Los Angeles). The victim was walking on the adjacent street with her friend and their children at the time. The pole fragments and the power wires severely injured our client, and killed her small daughter. This was a very hard fought case, and Bisno, Samberg & Mulvaney went up against over half a dozen defendants, including big insurance companies, truck manufacturing companies, and utility providers. There were numerous victims and the settlements totaled over $1 million. Our client was paid a substantial portion of that amount.
  • Truck accident: big rig truck vs. big rig truck: Two tractor-trailer rigs collided under mysterious circumstances in the middle of the night in the Utah desert, killing both drivers. The police report listed no witnesses. Bisno, Samberg & Mulvaney represented the wife and two small daughters of one of the deceased drivers in this extremely unusual and challenging case. Attorney John Samberg was assigned this case, in part because he is also a private investigator. Mr. Samberg was specially admitted to the Utah Bar (pro hac vice) in order to handle this case. He personally conducted the field investigations and located two eye witnesses whose names did not appear on the police report. These eye witness provided critical information that led the expert witnesses hired by Bisno, Samberg & Mulvaney to reconstruct the accident and prove that their clients' husband/father was not a fault. Bisno, Samberg & Mulvaney won settlements for the clients of $1,500,000.00 cash, and with our assistance, the clients were also able to obtain a structured settlement of part of the proceeds with lifetime benefits well in excess of $2,000,000.00. This case was a lawyer referral to Bisno, Samberg & Mulvaney by another law firm based on our excellent reputation and history of winning performance.
  • Motorcycle accident: motorcycle vs. big rig truck near remote intersection in the California desert. Bisno, Samberg & Mulvaney represented the father of a 17 year old motorcyclist who was killed when he rear-ended a tractor-trailer rig near midnight along a remote stretch of road in the California desert. This was a very challenging case because it was the motorcycle that hit the truck from behind at a high rate of speed, and it appeared that the victim was mostly at fault. Many other law firms would not have even thought there was a case to pursue, but through vigorous work and intense investigation Bisno, Samberg & Mulvaney was able to place some of the fault on the driver of the truck. The family received a settlement of nearly $100,000.00.
  • Golf cart on street accident: big rig truck vs. golf cart: A tractor-trailer hit a golf cart at an intersection severely and permanently injuring the driver of the cart (metropolitan Los Angeles). Bisno, Samberg & Mulvaney represented the adult male operator of the golf cart who was at work at the time, going from one of his employer's facilities to another across a public street. Peter Bisno was assigned this very unusual and challenging case. Attorney Bisno worked tirelessly for years on this case and through his tenacity was able to win a settlement for our client of approximately $500,000.00.
  • Passenger in back seat of car: big rig truck vs. car: A tractor-trailer hit a car mid-block in an industrial area of Los Angeles. The rear seat passenger was severely and permanently injured. Bisno, Samberg & Mulvaney represented the adult male client who was on his way to work at the time. This case was extremely difficult because of the legal issues arising from the fact that all of the occupants worked together, and were on their way to work at the time. There was significant comparative negligence on the part of the car driver as well. Peter Bisno was assigned this difficult case, and through his tireless efforts and successful handling of the complex legal issues, he was able to win a large settlement for our client.
  • Mid-air collision: light aircraft vs. light aircraft: Two small airplanes collided mid-air over Ventura County in California. Both occupants of one plane were killed. The three occupants of the other airplane were injured. Bisno, Samberg & Mulvaney represented father and minor son occupants of the plane that was able to land after the collision. Bisno, Samberg & Mulvaney vigorously litigated against the pilots of both planes, and their insurance companies, and we won a settlement for our clients that recognized that although neither suffered severely physical injuries, they suffered severe and permanent psychological injuries as a result of this very unusual and shocking accident.
  • Car accident with brain injury: car vs. car (metropolitan Los Angeles). Bisno, Samberg & Mulvaney represented a woman and her family in a case arising from a rear-end collision that sent our client's car into a tree. She suffered severe brain injury and was in a coma for weeks. Our vigorous work commenced just a few days after the accident, and based on a strong work-up and investigation, the case settled for the maximum available insurance proceeds (in the six-figures), just a few weeks later and without a law suit having to be filed. This case was referred to us by the victim's sister-in-law who was a former client extremely satisfied by our work. Our prompt and settlement maximized the net result to the family since we did not waste a lot of time and money with misdirected case work-up. Our efficient and pin-point efforts resulted in a maximum result under very difficult circumstances.
