Commercial Litigation and Business Disputes

Bisno, Samberg & Mulvaney is proud to represent a broad variety of business enterprises from a large national advertising agency to one of the nation's leading suppliers of skilled construction labor. We have successfully handled hundreds of matters for our business clients, ranging from putting out small fires, to winning complex and hard-fought trials involving millions of dollars. Our goal is to maximize our client's recovery as quickly and cost-effectively as possible.

Aggressive yet cost-effective litigation strategy is the foundation of our approach. Also, when appropriate we seek extraordinary remedies at the beginning of the litigation process, including the appointment of receivers and obtaining writs of attachment, in order to maximize our client's position in the case. Our practical approach emphasizes a rigorous cost-benefit analysis at all stages of litigation to ensure that the litigation budget fits the magnitude of the case.

Since our firm handles litigation in State, Federal and Bankruptcy Courts our clients enjoy continuity of representation when, as is very common, a matter starts out as a "litigation" file, then all or part of the case becomes a "bankruptcy" file. In these instances, unlike many firms that refer these matters out, the file continues to be administered by Bisno, Samberg & Mulvaney, with the entire case and long term goals of the client in mind.

Here are a few examples of cases successfully handled for our business clients.

State Court Trial. Two week bench trial in Los Angeles County involving a failed restaurant. Mr. Samberg represented the Defendants and defeated the Plaintiffs' claims of fraud and mismanagement.

Federal Court Trial. Bankruptcy Court adversary proceeding (bench trial) in Los Angeles involving valuation of a commercial recording studio; at issue, over $1 million. Mr. Samberg represented the Plaintiff (a bank) and prevailed on every issue of valuation, resulting in a complete victory for the bank.

State Court Trial. One week bench trial in Los Angeles County involving failure of a construction developer to pay a general contractor for work performed. Mr. Samberg was able to obtain a judgment for the general contractor against not only the corporate defendant, but was also able to pierce the corporate veil and obtain a judgment personally against the individual owner of the development company.

Mediation. Complex multi-party construction defect case involving the roof of a shopping center. Mr. Samberg represented one of the principal Defendants and after the case was successfully resolved with a minimum contribution by our client, its insurance company wrote a lengthy unsolicited letter praising attorney Mr. Samberg's superb work on the case. Mr. Samberg saved hundreds of thousands of dollars for the insurance company as a result of his thorough preparation, and impressive presentation.

State Court Trial. One week jury trial in Tucson, Arizona. Mr. Samberg prosecuted an action on behalf of a Southern California bank against personal guarantors of a loan to a bankrupt Arizona limited liability partnership. Mr. Samberg was specially admitted to the Arizona Bar (pro hac vice) and obtained a judgment against the defendants of over $2,000,000.00.

State Court Trial. One week bench trial in Los Angeles County involving the international sale of fabric and payment by letter of credit. Mr. Samberg successfully represented the Taiwan-based sellers in obtaining a judgment against the California based buyer.

Federal Court Trial. Bankruptcy Court objection to discharge (bench trial) in Oakland involving an attempt by a borrower to discharge a debt owed to our client, a Massachusetts based bank. The loan was made based on documents that had been forged by the borrower. Mr. Samberg litigated the matter successfully, the Bankruptcy Judge ruled that the bankruptcy filing was in bad faith, and the bank's interests were completely protected.
