Bisno, Samberg & Mulvaney is proud to represent banks, financial institutions, and loan servicers from across the United States. We handle a broad variety of matters for these clients, including unsecured and secured (personal and real property/commercial and residential) loans, complex litigation, guaranty litigation, and all aspects of bankruptcy. We bring to these cases a broad base of experience, from all aspects of these types of cases. Our practical approach emphasizes a rigorous cost-benefit analysis at all stages of litigation to ensure that the litigation budget fits the magnitude of the case.

Since our firm handles litigation in State, Federal and Bankruptcy Courts our clients enjoy continuity of representation when, as is very common, a matter starts out as a "litigation" file, then all or part of the case becomes a "bankruptcy" file. In these instances, unlike many firms that refer these matters out, the file continues to be administered by Bisno, Samberg & Mulvaney, with the entire case and long term goals of the client in mind.

Here are a few examples of cases successfully litigated for bank clients.

Federal Court Trial. Bankruptcy Court adversary proceeding (bench trial) in Los Angeles involving valuation of a commercial recording studio; at issue, over $1 million. Mr. Samberg represented a Southern California based bank and prevailed on every issue of valuation, resulting in a complete victory for the client.

State Court Trial. One week jury trial in Tucson, Arizona. Mr. Samberg prosecuted an action on behalf of a Southern California based bank against personal guarantors of a loan to a bankrupt Arizona limited liability partnership. Mr. Samberg was specially admitted to the Arizona Bar (pro hac vice) and obtained a judgment against the defendants of over $2,000,000.00.

Federal Court Trial. Bankruptcy Court objection to discharge (bench trial) in Oakland involving an attempt by a borrower to discharge a debt owed to our client, a Massachusetts based bank. The loan was made based on documents that had been forged by the borrower. Mr. Samberg litigated the matter successfully, the Bankruptcy Judge ruled that the bankruptcy filing was in bad faith, and the bank's interests were completely protected.
