Success Stories

Bisno, Samberg & Mulvaney has successfully handled hundreds of cases since its founding in 1985. Some of our verdicts, awards and settlements are listed here.

State Court Trial. Six week jury trial in San Bernardino County involving a train vs. auto accident resulting in death and serious injury. Mr. Samberg represented the Plaintiff and obtained a jury verdict of nearly $1.4 million (reduced by 50% for Plaintiff's comparative fault).

Federal Court Trial. Bankruptcy Court adversary proceeding (bench trial) in Los Angeles involving valuation of a commercial recording studio; at issue, over $1 million. Mr. Samberg represented the Plaintiff (a bank) and prevailed on every issue of valuation, resulting in a complete victory for the bank.

Mediation. Complex multi-party truck accident case involving the mysterious collision of two big rigs in the middle of the night in the Utah desert, killing both drivers. Mr. Samberg was specially admitted to the Utah Bar (pro hac vice) in order to handle this case on behalf of the widow and two small children of one of the deceased drivers. Although the police report listed no witnesses, as a veteran private detective Mr. Samberg was able to locate two eye witnesses who provided critical information that led an accident reconstruction that proved that the clients' husband/father was not a fault. Mr. Samberg won settlements for the clients of $1,500,000.00 cash, and with his assistance, the clients were also able to obtain a structured settlement of part of the proceeds with lifetime benefits well in excess of $2,000,000.00.

State Court Trial. One week jury trial in Tucson, Arizona. Mr. Samberg prosecuted an action on behalf of a Southern California bank against personal guarantors of a loan to a bankrupt Arizona limited liability partnership. Mr. Samberg was specially admitted to the Arizona Bar (pro hac vice) and obtained a judgment against the defendants of over $2,000,000.00.

State Court Trial. Two week bench trial in Los Angeles County involving a failed restaurant. Mr. Samberg represented the Defendants and defeated the Plaintiffs' claims of fraud and mismanagement.

State Court Trial. One week bench trial in Los Angeles County involving failure of a construction developer to pay a general contractor for work performed. Mr. Samberg was able to obtain a judgment for the general contractor against not only the corporate defendant, but was also able to pierce the corporate veil and obtain a judgment personally against the individual owner of the development company.

Mediation. Complex multi-party construction defect case involving the roof of a shopping center. Mr. Samberg represented one of the principal Defendants and after the case was successfully resolved with a minimum contribution by our client, its insurance company wrote a lengthy unsolicited letter praising attorney Mr. Samberg's superb work on the case. Mr. Samberg saved hundreds of thousands of dollars for the insurance company as a result of his thorough preparation, and impressive presentation.

Settlement. Single vehicle roll-over accident on I-15 between Las Vegas and Baker involving a rented car. Our client was a passenger who was asleep when the driver fell asleep at the wheel. Our client was partially paralyzed from the waist down. The car rental agency's insurance carrier denied coverage since the driver was not the renter. The file was referred to Bisno, Samberg & Mulvaney by another attorney who had been offered $15,000.00 to settle the case. After aggressively litigating the case against all interested parties, including directly against the insurance company, Mr. Samberg was able to obtain a settlement with a structured value of over $1,000,000.00, an amount higher than the face value of the insurance policy at issue.

State Court Trial. One week bench trial in Los Angeles County involving the international sale of fabric and payment by letter of credit. Mr. Samberg successfully represented the Taiwan-based sellers in obtaining a judgment against the California based buyer.

Settlement. Push/slip and fall case at a major league baseball stadium in California. Our client was returning to her seat when she was run into by a food vendor. She fell into empty seats, suffered severe injuries which required back surgery. There were no independent eye witnesses and the Defendant denied all liability. Mr. Bisno and Mr. Samberg took this case over from another law firm and worked it up for trial. On the eve of a three week jury trial, based on the strength of our preparation, the Defendant reversed its position and paid a generous settlement to our client.

Federal Court Trial. Bankruptcy Court objection to discharge (bench trial) in Oakland involving an attempt by a borrower to discharge a debt owed to our client, a Massachusetts based bank. The loan was made based on documents that had been forged by the borrower. Mr. Samberg litigated the matter successfully, the Bankruptcy Judge ruled that the bankruptcy filing was in bad faith, and the bank's interests were completely protected.

Binding Arbitration - HMO Medical malpractice case, failure to diagnose a rare form of chest cancer (soft tissue sarcoma). This case had been rejected by many other attorneys because of its difficulty and slim chance of success. Many attorneys and experts called the case "impossible to win". Yet, Mr. Bisno believed in the case and aggressively litigated the case, hiring internationally recognized experts and taking many depositions. The HMO hired a very well known trial lawyer who had tried dozens of cases successfully, having never lost a case before. The HMO refused to offer a dime to settle the case. Mr. Bisno immediately set the case before a three panel (jury) binding arbitration. Mr. Bisno's client won a sum close to $2 million at the Arbitration.

Binding Arbitration - Automobile Accident. Mr. Bisno was forced to try a complex automobile accident case on behalf of a client whose own insurance company refused to offer him any money, claiming the accident was a "fraud". The insurance company had even threatened to report Mr. Bisno's client for criminal prosecution claiming he committed insurance fraud. In truth and in fact, this was an example of the insurance company playing "hardball" with its own insured in failing to settle a case that should have been settled. At the Arbitration, the evidence presented by Mr. Bisno was so forceful and so convincing, that the Arbitrator, a very well respected retired Judge, angrily declared the insurance company witnesses "liars" and awarded Mr. Bisno's client a handsome sum of money. The insurance company lawyer and his representative claimed they were "stunned" by the Arbitrator's decision.

Binding Arbitration - Real Estate Dispute. Mr. Bisno and Mr. Samberg jointly arbitrated a case where their client claimed to have been defrauded in the purchase of a 30 unit apartment building by a real estate broker and seller. The real estate broker's lawyer was so confident that he would win that he offered a few thousand dollars as "nuisance value" to settle the case. The Arbitration lasted for months, and several real estate experts, asbestos experts, and economists testified. The real estate lawyer, who worked for one of the largest real estate companies in the United States, boasted that he had "never lost a case" and that he would "destroy" Mr. Bisno & Mr. Samberg's client at the Arbitration. What happened at the Arbitration was that he got the surprise of his life. Not only was he soundly defeated, his client was ordered to pay hundreds of thousands of dollars to Mr. Bisno and Mr. Samberg's client.

Binding Arbitration - Kaiser /HMO medical malpractice case, episiotomy repair mishandled resulting in fistula (hole) between the vagina and anus. Mr. Bisno took this case to binding arbitration. Prior to the binding arbitration, the attorney representing the HMO predicted that 9 times out of 10, the HMO would win this case. Apparently, she did not have much experience trying a case against Mr. Bisno, who won $50,000.00 for his client.

Settlement in the middle of Binding Arbitration - Kaiser / HMO medical malpractice case in which Kaiser allegedly failed to diagnose a brain tumor in a young child. The case was complex because the HMO contended that if an earlier diagnosis had been made, the child would have been subjected to radiation that could have caused brain damage. The Arbitration (trial) of this case had begun and Kaiser halted the proceedings in order to settle the case, agreeing to pay the child multiple payments of cash over a period of several years, totaling over $1 million.


Binding Arbitration - HMO Medical malpractice case, in which kidney biopsy was improperly performed. Mr. Bisno's client felt he had been victimized by the negligence of a Kaiser physician, and Kaiser believed the physician was not negligent in performing a kidney biopsy. The Arbitrator / Judge sided with Mr. Bisno's client who was awarded a substantial sum of money.

Settlement of Toxic Torts Case. In this case, Mr. Bisno's client, a construction company, was a defendant, not a Plaintiff, who was accused of being responsible for "contaminating" an office suite with pesticides. Counsel for Plaintiff demanded that millions of dollars be paid. Mr. Bisno's persistent investigation and discovery efforts led to the disclosure of information that dramatically reduced the value of the case. The case settled on the eve of trial, on terms very favorable to Mr. Bisno's client.
